Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of Fanova (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Fanova is a platform that connects fans and creators for custom requests, paid Q&A, messaging, and related interactions. We provide the marketplace tools; creators fulfill orders and are responsible for their own offerings and deliveries.

3. Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be old enough to form a binding contract in your jurisdiction (and at least 16, or the higher age required locally) to use the Service.

4. Creator responsibilities

If you use the Service as a creator, you agree to:

• Describe offerings honestly and set clear pricing, scope, and delivery expectations
• Deliver work that reasonably matches the agreed request, or communicate promptly if you cannot
• Only upload content you have rights to use and share
• Comply with applicable tax, payout, and legal requirements for your earnings
• Not misuse the platform for spam, fraud, or prohibited content

5. Fan / supporter responsibilities

If you place orders or message creators, you agree to:

• Provide clear, lawful request details
• Pay the amounts shown at checkout
• Not request illegal, abusive, or infringing content
• Respect creators’ boundaries and the scope of each offering

6. Payments, fees, and payouts

Payments are processed by Stripe. Prices are set by creators unless otherwise stated. Platform or processing fees may apply and will be disclosed where required — see our FAQ for current platform and Stripe fee details. Creator payouts are subject to Stripe Connect onboarding, verification, and our payout rules. Chargebacks, cancellations, and refunds are handled according to the order status, Stripe’s processes, and any applicable platform policies.

7. Content and intellectual property

You retain ownership of content you upload or create, subject to the rights needed for us to host and deliver the Service. By uploading content, you grant Fanova a non-exclusive license to host, store, display, and transmit that content as needed to operate the Service. Between fan and creator, ownership and usage rights for delivered work should be agreed in the order brief or offering terms; if silent, the fan receives a personal, non-exclusive license to use the delivered work for personal, non-commercial purposes unless the creator states otherwise.

8. Prohibited uses

You may not use the Service to:

• Violate laws or third-party rights
• Upload malware, scrape the Service abusively, or attempt unauthorized access
• Harass, exploit, or harm others
• Sell or solicit illegal goods/services or prohibited adult content involving minors
• Misrepresent identity, manipulate reviews/orders, or launder payments

9. Suspension and termination

We may suspend or terminate access if you breach these Terms, create risk for users or the platform, or if required for legal or security reasons. You may stop using the Service at any time. Provisions that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.

10. Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee uninterrupted operation, specific creator availability, or the quality of creator work. Creators are independent and are not our employees or agents for fulfillment purposes.

11. Limitation of liability

To the fullest extent permitted by law, Fanova and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our aggregate liability for claims relating to the Service will not exceed the greater of (a) the amounts you paid to us in platform fees (if any) in the 12 months before the claim or (b) USD $100.

12. Indemnity

You agree to indemnify and hold Fanova harmless from claims arising out of your content, your use of the Service, or your breach of these Terms, to the extent permitted by law.

13. Changes

We may update these Terms by posting a revised version on this page. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service.
